This readme file contains information pertaining to the supply of Electronic Navigational Charts (ENCs) published by the Australian Hydrographic Office (AHO) and ENC published by the New Zealand Hydrographic Authority, Toitu Te Whenua Land Information New Zealand (LINZ), for commercial use.

SECTION 1 IMPORTANT GENERAL INFORMATION

OFFICIAL ELECTRONIC CHARTS – Updated 06-Jan-2023

AusENC are official vector Electronic Navigational Charts (ENC) that provide coverage of:
  * Australian, Australian Antarctic Territory and Timor Leste waters published by the AHO as 'AU' ENCs,
  * Papua New Guinea published by the AHO as 'PG' ENCs 
  * Solomon Islands waters published by the AHO as 'SB' ENCs and 
  * New Zealand waters published by Toitu Te Whenua LINZ as 'NZ' ENCs.

CONVERSION OF AU or SB-CODED ENCS TO PG-CODED ENCS – Updated 06-Jan-2023

AU and SB-coded ENCs to PG-coded ENCs. 
As part of the testing of these new ENCs, it has been identified that there is the potential for a small number of ECDIS users to experience display problems with the adjusted AU / SB-coded ENCs on ECDIS Transas version 3.0.340 Build 5225. Users are advised to use caution and examine these ENCs at the voyage planning stage. 

The ENCs are:

AUSENC UPDATE STATUS - Updated 06-Jan-2023

The latest update status of every ENC within AusENC can be found at:

These references list the edition number and update numbers correct to the week of publication.

The AusENC Update Report attached to your weekly AusENC Update Notification email will advise you of the following changes to your subscribed packs each week:

TEMPORARY AND PRELIMINARY INFORMATION 

AusENC update service contains Permanent, Temporary and Preliminary Notices for AU, PG, SB and NZ ENCs.

AUSENC UPDATE SERVICE INFORMATION - Updated 28-Jan-2025

AusENC updates are issued weekly.

The AusENC services consists of:
  * 'Base dataset'  - issued in January and July.
  * 'Update datasets' - issued on all intervening weeks.
  * 'AusENC update notification' email - issued on the same day as Base and Update datasets.
  * ENC permits - attached to your update notification email, only if new ENCs or new editions of ENCs are added to your subscribed AusENC packs.
  * AusENC Update Report - issued every week, attached to your AusENC update notification email.

BASE DATASETS.  At the week of issue, Base datasets include the most up to date version of every ENC in the AusENC portfolio. 

UPDATE DATSETS. There are two types:
  * Cumulative Update datasets - Contain all updates issued since the latest base dataset release.
  * Incremental Update datasets - Contain updates that relate to one individual week release.  They must be loaded in the correct sequence.

Update datasets are not issued on the weeks where Base datasets are issued.

ENC PERMITS. These enable individual ENC to be viewable on a system with the corresponding S-63 User Permit. Every time they are issued, ENC Permit files contain permits for every ENC within your active AusENC pack subscriptions for a particular system.  

If you have AusENC subscriptions for multiple navigation systems (systems with different S-63 User Permits), you will receive a separate set of ENC permits for each system (S-63 User Permit).

AUSENC UPDATE REPORT. A single report applicable to as many systems as are included in your AusENC subscriptions. 
Besides listing updates to ENCs, new ENCs and new editions to your subscribed packs this report also lists pack expiry dates and notifies when it is time to renew.

TYPES OF AUSENC SERVICE: 

There are two types:

  * STANDARD UPDATE SERVICE. A free service. Throughout your AusENC subscription, it is your responsibility to download Base and Update datasets from the AHO website Product Downloads page at www.hydro.gov.au/webapps/jsp/downloads/products.jsp.

  * PREMIUM UPDATE SERVICE: A costed service. Throughout your AusENC subscription, all Base and Update datasets will be sent to you on CD by post.

IMPORTANT NOTES ABOUT INSTALLING AUSENC DATA AND ENC PERMITS

1. Update data must be used with the latest Base dataset. Errors will be experienced if an Update dataset is applied to a previous Base dataset release.

2. ENC permits correspond to a particular Base or Update dataset release. When new ENC permits are supplied, it is important to load them and the corresponding Base or Update dataset on your navigation system at the same time. 
Loading new ENC permits without the corresponding data may remove access to previously installed ENCs. 
Loading Base or Update datasets without corresponding ENC permits (when supplied) will deny access to new ENCs released in the Base or Update dataset and may even result in access disappearing to previously accessible ENCs (where a ENC has been cancelled and released in the same geographical area with a new file name).

To install AusENC data and permits, please follow the data install/data update procedure of your navigation system.

SECTION 2 - HYDROGRAPHIC OFFICE'S INFORMATION

SPECIFIC INFORMATION ABOUT ENCS PUBLISHED BY AUSTRALIA

CARRIAGE REQUIREMENTS - Updated 28-Jan-2025

AusENC allow vessels navigating in Australia on an International Maritime Organisation (IMO) compliant Electronic Chart Display and Information System (ECDIS) to meet Safety of Life At Sea (SOLAS) Chapter V regulations covering the carriage of electronics charts and ECDIS. 

AusENC allow commercial vessels 12 metres or more in length that are engaged in Australian domestic operations, to meet domestic commercial vessel regulations when used in an IMO compliant ECDIS or a compliant Electronic Chart System (ECS).

In Australian waters, the Australian Maritime Safety Authority (AMSA) sets the rules, under the Australian Navigation Act 2012, for vessels entering and operating within Australian waters. 

The Australian implementation of SOLAS regulations are set out in AMSA Marine Orders and AMSA Marine Notices. 

Australian domestic commercial vessels are required to comply with the AMSA's National Standard for Commercial Vessels (NSCV).

The AHO recommends vessels that require coverage extending beyond Australian, Papua New Guinea, Solomon Islands and Timor Leste waters to subscribe to a global ENC service rather than combine other services with AusENC.

DATA APPEARANCE 

Australian published ENCS contain either the same or greater levels of detail than the corresponding paper chart.  In particular ENCs may contain 1-metre contours that are not available in the paper chart.  This will enable the full benefits of ECDIS and particularly its safety depth alarm function to be used most effectively.

The geographical limits of individual ENCs are likely to differ from the geographical limits of corresponding paper charts.

UPDATES

Updates for AU, PG and SB ENCs within AusENC are issued weekly.  They include all Permanent, Temporary and Preliminary Updates. For updates to AHO nautical publications and any 'AUS', 'PNG' and 'SLB' Paper Nautical Charts used as a backup to ECDIS, mariners should consult the fortnightly Australian Notices to Mariners available via the AHO website at www.hydro.gov.au.

Australian published ENC include all significant hydrographic information obtained by the AHO at date of compilation.  Significant information is updated weekly. All reasonable efforts have been made to ensure the accuracy and completeness of the information, including third party information, incorporated in this product.  The AHO regards third parties from which it receives information as reliable, however the AHO cannot verify all such information and errors may therefore exist.  Where possible, indications regarding the reliability of information are noted or symbolised in the product. Users should familiarise themselves with the meaning of any notes or symbols.  The AHO does not accept liability for errors in third party information or the inappropriate use of this product.

DATA APPEARANCE

QUALITY OF DATA. The M_QUAL object with a CATZOC attribute is included in New Zealand ENCs as an overlay. This may affect the appearance of the New Zealand ENCs as the ZOC polygons may overlap the LNDARE.

MINIMUM SCALE. The SCAMIN step values for object and attribute combinations have been applied to New Zealand ENCs following international standards.

Updates for New Zealand ENCs are issued weekly. New Zealand ENC updates are issued for all Permanent, Temporary and Preliminary Notices to Mariners. New Zealand Notices to Mariners can be downloaded from the LINZ website at www.linz.govt.nz or subscribe online at the LINZ website to receive fortnightly Notices to Mariners via email.

AusENC USER LICENCE

1. SUPPLY of AusENC

1.1 The AusENC supplied by the AHO to you, the User, is subject to the terms and conditions of this Licence.

1.2 The Licence constitutes the whole agreement between the Commonwealth of Australia (represented by AHO) and you, the User, with respect to AusENC.

	
2. DEFINITIONS

2.1 In these Licence Conditions, unless the contrary intention appears:

    "AHO" means the Australian Hydrographic Office.

    "Chart Data" means the Official AusENC specified in this Licence, including Updates, that the User is permitted to use in accordance with these Licence Conditions;

    "Disk" means the optical media embodying AusENC;

    "Licence" means the licence granted by the Commonwealth to use the AusENC Chart Data, which is subject to these Licence Conditions;

    "AusENC" means the Electronic Navigational Chart data stored in International Hydrographic Organization S-57 format and encrypted using the IHO S.63 data protection scheme and supplied by the AHO.  It includes any Updates supplied to you by the AHO;

    "Update" means any modified, corrected or updated Chart Data supplied to you, the User, within the licence period.

    "User" means the person, Department, agency, statutory authority, corporation or other entity who has purchased or has been issued with AusENC and will use the Chart Data.


3. GRANT OF LICENCE

3.1 The Commonwealth grants to the User a non-exclusive licence to use and display the Chart Data in AusENC, subject to this Licence.

3.2 The User may transfer the Licence to a third party provided AHO is notified by the AusENC distributor of the details of the new User. Any transfer is subject to the terms and conditions of the Licence.


4. COPYRIGHT ACKNOWLEDGMENT

4.1 The User acknowledges that AusENC, including the Chart Data, is a special, unique and valuable product in which the copyright and other applicable intellectual property rights are owned or controlled by the Commonwealth of Australia.  Any information supplied by other national charting authorities is also subject to copyright.


5. PERMITTED USES

5.1 The User may:

  * install the Chart Data onto a permanent storage device;

  * make and maintain a single back-up copy of the Chart Data provided it is used only for back-up purposes and the User keeps possession of both the back-up and original Chart Data;

  * authorise day to day users of AusENC to use and display Chart Data provided they are first made aware of and agree to abide by the Licence.

5.2 The Licence gives the User certain limited rights to use AusENC.  You, the User, do not become the owner of, and AHO retains title to, AusENC.  In addition you agree to use reasonable efforts to protect AusENC from unauthorised use, reproduction, distribution or publication.  All rights not specifically granted in this Licence are reserved by the Commonwealth.


6. USES NOT PERMITTED

6.1 The User may not:

  * make copies of AusENC except as permitted in clause 5.1 above;

  * install AusENC on a network, unless authorised by AHO;

  * alter, decompile, disassemble, reverse-engineer or otherwise reduce AusENC to human perceivable form;

  * remove or obscure AHO copyright and trade mark notices.

6.2 If the equipment used to display AusENC is capable of producing hard copy, such hard copy must not be sold, hired or otherwise transferred to any third party, and shall not be used for navigation. If the User wishes to obtain a paper copy of an Official Chart for navigational or evidentiary purposes, the User should contact the AHO to find out details of their nearest authorised distribution agent.

6.3 The User shall not publish, distribute or otherwise exploit AusENC commercially without the prior written approval of the Commonwealth. For further details, the User should contact the Licensing Manager at the AHO by email (hydro.licensing@defence.gov.au).


7. USER CONDITIONS

7.1 AHO reserves the right to change and amend the data format in which AusENC is stored at any time.


8. UPDATES

8.1 The User agrees that access to and use of any Updates provided to the User will also be subject to this Licence.


9. WARRANTY

9.1 Where a statute implies a term, condition or warranty into this Licence and that statute prohibits the exclusion of that term, AHO liability for breach of such an implied term is limited to one or more of the following:

  * the replacement of the goods to which the breach relates or the supply of equivalent goods;

  * the repair of the goods; or

  * the payment of the cost of replacing the goods or of acquiring equivalent goods; or

9.2 Except as provided for in clause 9.1, the AHO makes no express warranty or representation about AusENC and takes no responsibility for the compatibility of individual software programs with AusENC.


10. TERMINATION

10.1 This Licence may be terminated immediately by notice in writing to the User for breach of any of these Licence Conditions.

LABELLING OF AUSENC BASE AND UPDATE DATASETS - Updated 28-Jan-2025

Base and Update datasets are labelled according to the calendar week the data is released in. For example, an AusENC Base released on Friday 06 January 2023 will be labelled "Week 01-2023". An AusENC Update released on Friday 20 January 2023 will be labelled "Week 03-2023". 

Because Updates are released weekly, week labels will increment by one (for example, Week 03-2023, Week 04-2023, Week 05-2023 etc).

RETENTION OF AUSENC DATA FOR BACKUP PURPOSES

For backup purposes only the following should be retained:

a. the latest Base dataset plus

b. All separate weekly incremental Update dataset downloads since the latest Base dataset, or the latest Cumulative Update download / Update CD for the same period.
